This ESIGN Consent explains your rights when you receive documents, disclosures, and communications electronically from IMM Fund Inc. (“IMM Fund”). By using our online Services and submitting applications electronically, you agree to this ESIGN Consent.

1. Electronic Records and Signatures

You agree that IMM Fund may provide you with loan applications, disclosures, notices, agreements, and other documents (“Electronic Records”) electronically, including via email, online portal, or website. You consent to the use of electronic signatures in place of handwritten signatures where permitted by law.

2. Right to Paper Copies

You may request a paper copy of any Electronic Record that we provide to you electronically. To request a copy, contact us at support@imm.fund. We may charge a reasonable fee where permitted by law.

3. Withdrawing Consent

You may withdraw your consent to receive Electronic Records at any time by contacting us at support@imm.fund. If you withdraw consent, we may be unable to continue providing some or all online Services or loan products to you.

4. Updating Your Contact Information

You are responsible for providing a valid email address and updating it when it changes. To update your email address or other contact information, contact us at support@imm.fund.

5. Hardware and Software Requirements

To receive and retain Electronic Records, you must have:

  • A device with internet access (computer, tablet, or smartphone);
  • A current web browser capable of rendering HTML and viewing PDFs;
  • Access to a valid email account; and
  • Storage or printing capability to keep a copy of Electronic Records.

6. Legal Effect

Your consent to this ESIGN policy means that Electronic Records and electronic signatures have the same legal effect as paper documents and handwritten signatures, to the fullest extent permitted by applicable law, including the U.S. Electronic Signatures in Global and National Commerce Act (ESIGN).
